These Terms & Conditions form a binding agreement between you and FlyX, operated by HiCheapAir (referred to as “FlyX”, “we”, “us” or “our”), covering your use of our website, mobile site and mobile application (together, the “Platform”) and any booking you make through it.

By accessing the Platform or making a booking you accept these terms and our Privacy Policy. If you do not accept them, please do not use the Platform. Please read section 2 carefully — it explains the limits of what FlyX is responsible for.

1. About These Terms

We may amend these terms at any time to reflect changes in our services, supplier rules or the law. The revised terms apply from the moment they are posted on this page, and the date at the top shows when they were last changed. The terms that apply to a booking are those in force when the booking is confirmed. Individual products, offers and promotions may carry additional conditions, which apply alongside these terms.

2. Our Role: FlyX Is an Intermediary

FlyX is a travel booking and facilitation platform. We are not an airline, hotel, tour operator or transport provider, and we do not own, operate or control the services you book. When you make a booking, the contract for the travel service itself is between you and the supplier — the airline, hotel, holiday operator or activity provider. FlyX acts as an intermediary that helps you compare options, complete the reservation and pass your details to that supplier.

As a result, FlyX is not responsible for and accepts no liability for the acts, omissions or service standards of any supplier, including delays, schedule changes, rescheduling, overbooking, denied boarding, downgrades, cancellation by the supplier, strikes, loss of or damage to baggage, the condition or amenities of a hotel or room, or the insolvency of a supplier. Claims arising from the delivery of a travel service must be made against the supplier concerned. We will, on request, pass on information and support your claim where we reasonably can.

Fares, room rates, availability, images, amenity lists and descriptions on the Platform are supplied by airlines, hotels and aggregators. We take reasonable care in displaying them but do not warrant that they are complete, accurate or free from error. Hotel star ratings are a general guide only.

3. Eligibility

To use the Platform you must be at least 18 years old and legally capable of entering into a binding contract under the Indian Contract Act, 1872. By booking, you confirm that you meet these conditions and that you will use the Platform only to make genuine bookings for yourself or for people you are authorised to act for. Where you book for others, you must inform them of these terms and of the supplier rules applying to their booking.

4. Your Account

You are responsible for keeping your login credentials confidential and for all activity that takes place under your account. Tell us immediately if you suspect unauthorised access. You must give accurate, current and complete information when you register and keep it up to date.

We may suspend, restrict or close an account, and refuse access to the Platform, where we reasonably believe these terms have been breached, where an account is being used fraudulently or abusively, or where we are required to do so by law.

5. Making a Booking

A booking is confirmed only when the supplier issues a ticket, voucher or confirmation number and we send you the corresponding confirmation. A search result, a held seat, a payment initiation or an on-screen message does not by itself create a confirmed booking.

You are responsible for the accuracy of the details you enter. Passenger names must match the passport or government photo ID that will be carried on the trip, exactly. Airlines and hotels frequently refuse boarding or check-in where names do not match, and most fares do not permit a name change after ticketing. Corrections, where a supplier permits them at all, usually attract a fee. FlyX is not liable for losses caused by incorrect names, contact details, dates, travel documents or passenger information supplied by you.

Occasionally a booking cannot be completed after payment — for example where the supplier withdraws the fare, the inventory sells out, the fare is displayed in error, or the booking fails a fraud or verification check. In such cases we will inform you and refund the amount collected. Our liability in that situation is limited to that refund.

6. Pricing, Fees and Taxes

Fares and rates change constantly and are not guaranteed until the booking is confirmed. The price shown at the time of booking includes the supplier fare together with applicable taxes and surcharges, and any FlyX convenience or service fee, which is shown separately before you pay.

Convenience and service fees are charged for the booking service we provide and are separate from the supplier fare. They are non-refundable once a booking is confirmed, unless the booking fails for a reason attributable to us. We may revise our fees from time to time; any change applies only to bookings made after the revision and is displayed to you before payment.

A payment gateway charge may be added according to the payment method you choose. It is shown as a separate line before you pay and is retained by the payment provider, so it is not returned to you if the booking is later cancelled.

Certain charges are collected directly by the supplier and are not included in the price shown on the Platform. These commonly include seat selection, excess baggage, meals, hotel resort fees, city or tourism taxes, security deposits, early check-in or late check-out charges, and local charges payable at the destination.

If, because of a technical fault or a pricing error, the amount collected from you is less than the correct total, we will contact you with the shortfall. Where the shortfall is not paid before travel, the booking may be cancelled. Where a fare is displayed at an obviously incorrect price, we reserve the right to cancel the booking and refund you in full rather than honour that price.

7. Payments

Payment must be made in full using one of the methods offered on the Platform. Payments are processed by third-party payment gateways and banks, and approval depends on them. We do not store your full card number, CVV or banking passwords.

If an amount is debited but the booking does not confirm, the amount is normally reversed by the payment provider within their standard settlement cycle. If it has not reached you within that period, contact us with the transaction reference and we will follow it up with the provider.

We may carry out verification or anti-fraud checks before confirming a booking, including asking you to provide proof of identity or proof that the payment instrument belongs to you. Bookings may be held or cancelled where those checks are not satisfied.

8. Communication

We communicate about bookings by email, SMS, WhatsApp, push notification and telephone, using the contact details you supply. It is your responsibility to enter these correctly and to check them, including your spam folder. SMS and messaging alerts are provided as a convenience and we are not liable if a message is delayed or not delivered.

Airlines and hotels notify schedule changes and cancellations on their own timelines. While we pass on the information we receive, we are not the source of it and cannot guarantee that a notification will reach you before departure. Please reconfirm your flight status with the airline before travelling.

9. Cancellations, Changes and Refunds

Cancellation and change rules are set by the supplier and by the fare or rate type you select, not by FlyX. Many discounted fares and promotional hotel rates are non-refundable or non-changeable. The rules applying to your booking are shown before you pay, and you should read them.

Where a cancellation or change is permitted, the amount refundable is the supplier fare less the supplier cancellation charge, less any FlyX service fee, and less any payment gateway charge that is not returned to us. Convenience and service fees are non-refundable.

A refund is calculated on the amount you actually paid, not on the pre-discount fare. Where a coupon or promotional discount reduced what you paid, that discount is not refunded to you and the coupon is not reissued or restored for future use. Where a booking is only partly cancelled, any discount already applied is apportioned across the booking and only the cancelled portion is considered.

Customers cannot cancel or reschedule a booking directly on the website or app. Contact FlyX Support at support@flyx.in with your booking reference. Our team checks supplier rules, charges and availability before taking any action. A cancellation or change is effective only once we confirm it to you.

Approved refunds are made to the original payment method. Timing depends on the supplier releasing the funds and on your bank or card issuer, and can take several weeks for airline refunds. We will share the supplier reference on request so that you can track it. Where an airline or hotel issues a credit shell or voucher instead of cash, we can only pass on what the supplier provides.

Where a supplier cancels a service, your entitlement is governed by that supplier and by the applicable passenger rights rules. We will assist you in claiming from them, but FlyX does not fund a refund the supplier has not released.

10. Travel Documents, Visas and Health Requirements

You are solely responsible for holding valid travel documents for your whole journey, including a passport with sufficient remaining validity, visas for your destination and for any country you transit through, permits, and any vaccination or health certificates required. Requirements differ by nationality and change frequently.

Please verify requirements directly with the airline and the relevant embassy or consulate before you travel. FlyX does not provide immigration advice and is not liable for denied boarding, denied entry, deportation, fines or any other loss caused by missing, expired or non-compliant documents.

11. Check-in, Baggage and Airline Rules

Check-in deadlines, baggage allowances, seat assignment, carriage of special items, unaccompanied minors, pets and assistance requests are governed by the operating airline conditions of carriage. Special requests such as meals, seats or wheelchair assistance are forwarded to the supplier but are never guaranteed unless the supplier confirms them.

Please arrive at the airport well ahead of the airline check-in deadline. FlyX is not responsible for a missed departure caused by late arrival, security queues, or a missed connection on separately issued tickets.

12. Hotels and Holiday Packages

Hotel bookings are subject to the property house rules, including check-in and check-out times, minimum age, occupancy limits, ID and deposit requirements, and local taxes payable at the property. Photographs and amenity lists are supplied by the property and may not reflect the specific room allotted. Room type is confirmed at booking; a specific room, floor or view is a request only.

Holiday packages are delivered by the operator named in the itinerary. Inclusions, exclusions, transfers and sightseeing are as stated in the package. Itineraries may be varied by the operator for reasons of weather, safety, local conditions or minimum group size.

13. Permitted Use of the Platform

The Platform is provided for your personal, non-commercial use. You agree not to:

  • make speculative, false or fraudulent bookings, or bookings in anticipation of demand
  • use robots, spiders, scrapers or any automated means to access, monitor, copy or extract content, fares or availability without our written permission
  • bypass any measure we use to restrict access, including robot exclusion instructions and rate limits
  • place an unreasonable load on our infrastructure, or interfere with the operation or security of the Platform
  • resell, reproduce, republish, frame, mirror or create derivative works from any part of the Platform or its content
  • deep-link to any part of the Platform, including the booking flow, without our written permission
  • upload or transmit anything unlawful, defamatory, obscene, infringing, misleading as to its origin, harmful to minors, or containing viruses or malicious code
  • impersonate another person or use the Platform to violate anyone else legal rights

14. Fraud Prevention

Where a booking or account shows signs of fraud, abuse or suspicious activity, we may verify or pre-authorise the payment instrument, hold or cancel the associated bookings, and suspend or close the related accounts. Where fraudulent activity has occurred we reserve the right to take legal action and to recover the resulting losses and costs. If you believe a booking of yours has been cancelled in error, contact our support team.

15. Intellectual Property

All content on the Platform — including text, layout, graphics, images, logos, icons, software and the underlying compilation of fares and availability — is owned by FlyX or its suppliers and licensors and is protected by copyright and trademark law. Displaying a trademark or logo on the Platform does not grant you any licence to use it. You may print or download your own itinerary and booking documents for personal travel use; any other copying, distribution or commercial use requires our prior written consent.

Any feedback, suggestion or other material you send us is treated as non-confidential, and you grant us the right to use it without restriction or payment.

16. Disclaimer of Warranties

The Platform and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.

We do not warrant that the Platform will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Platform or its servers are free from viruses or other harmful components. Access may be interrupted by factors outside our reasonable control, including internet or telecommunications failures, and by planned or emergency maintenance. Listing a product or supplier on the Platform is not an endorsement or recommendation of it.

17. Limitation of Liability

To the fullest extent permitted by law, FlyX and its directors, employees, agents, suppliers and licensors will not be liable for any indirect, incidental, special, consequential, punitive or exemplary loss, including loss of profit, revenue, business, goodwill, data or anticipated savings, arising out of or connected with these terms, the Platform, any booking, or any inability to use the Platform, whether the claim is in contract, tort, negligence or otherwise.

Our total aggregate liability to you for all claims arising out of or connected with these terms, the Platform or any booking will not exceed the total convenience and service fees actually paid by you to FlyX for the booking that gave rise to the claim.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by our negligence. Your statutory rights as a consumer are not affected.

18. Indemnity

You agree to indemnify and hold harmless FlyX, its affiliates and their respective directors, employees and agents from any claim, loss, liability, cost or expense, including reasonable legal fees, arising out of your use or misuse of the Platform, your breach of these terms, your breach of any supplier condition, or your infringement of the rights of any third party.

19. Force Majeure

We are not liable for any failure or delay in performing our obligations that is caused by events beyond our reasonable control, including natural disasters, epidemics and pandemics, war, civil unrest, terrorism, strikes, government action or restriction, airspace or border closure, adverse weather, fire, power failure, and failure of internet, telecommunications or supplier systems.

20. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. The courts and tribunals at Gurdaspur, Punjab, India will have exclusive jurisdiction over any dispute arising out of or in connection with these terms or your use of the Platform.

21. Grievance Redressal

In accordance with the Information Technology Act, 2000 and the rules made under it, and the Consumer Protection (E-Commerce) Rules, 2020, we operate the following escalation process. We acknowledge every grievance within 48 hours and aim to resolve it within one month of receipt.

22. General

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any right or provision is not a waiver of that right or provision, and any waiver is effective only if given by us in writing. These terms, together with the Privacy Policy and any product-specific conditions, form the entire agreement between you and FlyX regarding the Platform. You may not assign your rights under these terms without our written consent.
